Who it is for
Article 127.a) of the Regulation puts it this way: having held a residence permit not granted for exceptional circumstances, in the two years immediately before the filing date, whose renewal did not take place for reasons other than public order, security and public health.
Each piece of that sentence filters cases, so it is worth taking apart:
- Having held a residence permit: residence and work as an employee or self-employed, non-lucrative residence, a student who moved to residency, family member of an EU citizen. Any under the general or ordinary regime counts.
- Not for exceptional circumstances: a previous arraigo does not serve as the basis. Nor does a humanitarian permit.
- In the two years immediately before: the window is short. If the permit expired three years ago, this route is closed.
- Renewal not taking place for reasons other than public order: that is, if you did not renew because you lost your job, lacked means or missed the deadline, you fit. If you did not renew because of a public order problem, you do not.
The Regulation adds an important proviso: it may be requested where there is a judgment refusing the charge, dismissal of proceedings or acquittal. Criminal proceedings that ended without conviction do not close the door.
What sets it apart from the other routes
Compared with arraigo social, it requires no integration report, family ties or means of 100% of the IPREM. Compared with arraigo sociolaboral, it requires no employment contract. What it requires is a track record: having been inside the system recently.
All the general requirements of article 126 do apply, including the two years of continuous stay in Spain. In most of these cases that requirement is already more than covered by the previous period of legal residence, but it must be documented all the same.
Specific documents
- Previous foreigner identity card, even if expired, or the decision granting that permit.
- Up-to-date employment history, which besides proving the track record helps prove time in Spain. It downloads in two minutes with a certificate: how to get the employment history report.
- Proof of why it was not renewed, where a document exists: decision ending the permit, refusal of renewal, or simply the absence of a decision if the application was never filed.
- If there were criminal proceedings, the dismissal decision, the acquittal or the judgment refusing the charge.
- Criminal record certificate from your home country if five years of continuous stay in Spain is not proved.
General requirements, asked for in every type
Article 126 of the Regulation requires them to be met cumulatively, that is, all at once:
- Being in Spain when the application is filed and not being an applicant for international protection with an open file.
- Having stayed in Spain continuously for at least the two years before the application. Arraigo familiar is the only exception: it requires no minimum stay.
- Not being a threat to public order, security or public health.
- Having no criminal record in Spain or in the countries of residence during the five years before entering Spain, for offences provided for in Spanish law.
- Not being listed as non-admissible in countries with which Spain has an agreement to that effect.
- Not being within a period of commitment not to return to Spain.
- Having paid the processing fee.
- Not holding a stay or residence permit and not being a party to another procedure to grant, extend, renew or modify permits. This last requirement is new: it was added by Royal Decree 316/2026 and has been in force since 16 April 2026.
That last point deserves attention because it changes the strategy of many files: you can no longer have two procedures open at once. If an application is in progress, it must be decided or withdrawn before applying for arraigo.
How the procedure works
A permit for exceptional circumstances requires no visa and is applied for in person before the competent body, except for minors or people who need support to exercise their legal capacity, where their legal representative may file it.
With the application you provide a full copy of your valid passport, registration card or travel document valid in Spain; the signed employment contract where required; and the documents proving the specific situation claimed. For arraigo you also provide the criminal record certificate from the country or countries where you lived during the five years before entering Spain. The immigration office requests the Central Criminal Records report and the police report ex officio.
There are two cases where third-country records need not be proved: having stayed continuously in Spain for the five years immediately before the application, or having proved it in a previous application within those five years without having left since.
If the documents are incomplete, the administration requests correction with a deadline that cannot exceed fifteen days. If it is not corrected, the file is closed as withdrawn. That is by far the most frequent reason for the lost files that reach this gestoría.
Tracking the file needs no phone calls: see how to check the status of an immigration file. Once the permit is granted, there is one month from notification to apply in person for the foreigner identity card.
A note on strategy
The two-year window makes this a matter of calendar. If your permit expired a year and a half ago, you have room, but not much, and the file takes time to prepare between criminal records and proof of stay. If you are close to the limit, the first decision is not which documents to gather but whether this route arrives in time or whether to prepare an arraigo sociolaboral with a contract in parallel.
And remember the new general requirement: you cannot have another residence procedure open when filing. If you left a renewal in progress and never learned how it ended, check before anything else.

Frequently asked questions
Does it apply if my previous permit was an arraigo?
No. The Regulation requires that the previous permit was not granted for exceptional circumstances, and arraigo is. It must be a permit under the ordinary regime.
How long do I have since my card expired?
Two years. The previous permit must have been held in the two years immediately before the filing date.
What if I did not renew because I lost my job?
You fit. The law only excludes cases where renewal did not take place for reasons of public order, security or public health. Losing a job or lacking means are not those reasons.
Do I need an integration report or a contract?
No. This type requires no social integration report, family ties or employment contract. It does require all the general requirements of article 126.
I had criminal proceedings. Does that affect me?
It depends on the outcome. The Regulation expressly allows the application where there is a judgment refusing the charge, dismissal of proceedings or acquittal.
