NIE and TIE, precisely
NIE stands for número de identidad de extranjero. It is the tax and administrative identifier the Spanish state assigns to a foreign national, it never changes, and you need it to buy property, sign a mortgage, inherit, open a business or be paid a salary. Holding one says nothing about your immigration status.
TIE stands for tarjeta de identidad de extranjero. It is the plastic card issued after a residence permit is granted; it carries your photograph, your NIE and the type and expiry of the permit. Getting it involves fingerprinting in person, and you have one month from the notification of a favourable decision to apply for it.
EU citizens are a separate case: they register in the Central Register of Foreign Nationals and receive a green certificate, not a TIE.
Renewal: the dates that decide everything
Article 80 of the Regulation is unambiguous for employed work and residence permits, and the same logic runs through the others:
- Renewal must be filed during the two months before the permit expires.
- Filing within that window extends the validity of the previous permit until the file is decided. You are not left without papers while you wait.
- It is also extended if the application is filed within three months after expiry, but a penalty procedure is then opened under article 52.b) of Organic Law 4/2000.
And the part few people know: under article 81 a renewal of a work and residence permit is granted for four years, unless long-term residence is due instead, and its effects run from the day after the previous permit expired, so no gap opens in your residence record.
Renewing without a current contract
Losing a job does not automatically mean losing residency. Article 80.2 allows renewal where you have had at least three months of work in the year plus one of: a new contract with social security registration at the time of applying; a new contract conditional on the renewal being granted; or termination for reasons beyond your control while remaining continuously registered as a jobseeker. It also allows renewal with nine months of social security registration out of twelve, or where a relative meets the income requirements to sponsor you.
One document that gets forgotten every time: the regional authorities' report certifying school enrolment of dependent minors of compulsory school age. It is required with the application.
If your permit expired or you never had one
There is usually a route back. With two years of continuous residence in Spain, the arraigo routes lead to a residence permit without leaving the country: employment-based, family-based, training-based, or the second-chance route for people who held a permit within the last two years and could not renew it.
After five years of legal continuous residence, long-term residence opens up, in a national and an EU version, the second one easing movement to other member states. Later still comes Spanish nationality by residence.
You can check the state of any file online without phoning anyone: how to check an immigration file. And the documentary base for almost everything is the padrón registration.

Frequently asked questions
What is the difference between NIE and TIE?
The NIE is your permanent foreigner identification number, used by every Spanish administration. The TIE is the physical card proving a residence permit. You can hold an NIE without being a resident, for example to buy property, but residents also need the card.
When should I file my renewal?
During the two months before the permit expires. Filing in that window extends the validity of the previous permit until the file is decided.
I filed late. Is it too late?
Not if you are within three months after expiry. The previous permit is still extended, but a penalty procedure is opened. After those three months, renewal is no longer possible.
How long is a renewal granted for?
A renewal of a work and residence permit is granted for four years, unless long-term residence is due instead, and its effects run from the day after the previous permit expired.
Do EU citizens need a TIE?
No. EU citizens register in the Central Register of Foreign Nationals and receive a green registration certificate instead.
