Who can be reunited
Article 66 of the Regulation closes the list, and it is worth reading slowly because almost every refusal starts here:
- Spouse over eighteen, provided there is no de facto or legal separation and the marriage was not entered into fraudulently. No more than one spouse can be reunited, even if the personal law allows polygamy.
- Unmarried partner in a relationship similar to marriage. It is valid if the relationship is entered in a public register of an EU state, or if an unregistered stable cohabitation of at least twelve continuous months is proved. With children in common that prior period is not required.
- Children of your own or of your spouse or partner, under eighteen at the time of application; also adult children with a disability requiring support or who cannot provide for their needs because of their health. When they are the children of only one member of the couple, sole parental authority, exclusive custody or the other parent's consent is needed.
- Persons legally represented by the sponsor, with the same age and health limits.
- First-degree ascendants of your own or of your spouse or partner, when they are dependent, over sixty-five and there are reasons justifying the need. On humanitarian grounds those under that age are admitted exceptionally.
- An adult child who will act as carer of the sponsor, when the sponsor has a recognised degree of dependency among those of article 26 of Law 39/2006.
That last case is recent and little known, and it solves situations that previously had no legal way out.
The three requirements to prove
Financial means
Article 67.1 sets income or periodic earnings equivalent to 150% of IPREM for a unit formed by the sponsor and one family member, plus 50% of IPREM for each additional member. IPREM is updated each year in the Budget Law, so the percentage is stable but the figure is not: check it in the official source before filing.
Details of the calculation that change results:
- Income is counted at its gross value, including the proportional part of extra pay, except for economic activities, which go by net income.
- Pensions and benefits count, contributory or not, public or private.
- Study grants, housing grants, compensatory or maintenance payments (unless in favour of the person to be reunited) and social assistance income do not count.
- Stable assets are the average amount over the last six months.
- When minors are reunited, the amount may be reduced in view of the best interests of the child, with its own rule linked to the guaranteed income of the Minimum Living Income.
Adequate housing
It is proved with the report issued by the town council or regional government of the place of residence. It looks at number of rooms, occupants, habitability and the title giving the right to occupy the home. It is the step that takes longest, so it is requested first.
Health insurance
Public or private cover equivalent to that of the National Health System for the sponsor and the family members.
When it can be requested and how the procedure goes
The application can be filed when the sponsor has lived in Spain for at least one year and has applied for a permit to reside for at least another year. There are two exceptions: holders of long-term or EU long-term residence granted in Spain, to reunite ascendants, who can file it together with the application for that long-term status; and those residing in Spain because of their previous status as EU long-term residents in another member state.
The sponsor files it in person at the immigration office, on the official form, with their passport, proof of means, the housing report, the insurance, the sworn statement that no other spouse or partner lives with them, and the family member's documents with the ties proved.
Once the permit is granted, its effect is suspended: the family member applies for the visa at the consulate and the permit has no effect until they obtain the visa and enter Spain, which must happen within one month at most.
A little-known and very useful consequence: the reunification permit of the spouse, partner or children allows employed or self-employed work with no further procedure, anywhere in the country, in any occupation or sector, provided the minimum working age is exceeded. No separate work permit has to be requested.
While the file is under way you can follow it without calling anyone: checking the status of the file, and for the visa at the consulate, Mercurio.
Afterwards: renewal and independence
The reunited family member's permit is renewed while the circumstances that led to its grant remain. Over time, the spouse or partner and the children can obtain a residence permit independent of the sponsor, which is what breaks the administrative dependency within the family. The cases and periods are in the ministry's information sheet 11, linked below.
If the sponsor has Spanish nationality, the route is different. Since the 2025 Regulation there is a specific permit for family members of Spanish nationals, regulated in articles 93 to 98. Its requirements must not be mixed with general reunification or with the card for a family member of a citizen of another Union state.
To tell the regime apart and prepare the right evidence, use the family reunification test. If you want to bring parents or parents-in-law, see the specific guide on how to bring your parents to Spain.

Frequently asked questions
How much do I have to earn to reunite my family?
150% of IPREM for a unit of two people and a further 50% of IPREM for each additional member. Study and housing grants, compensatory or maintenance payments and social assistance income do not count.
How long must I have lived in Spain?
At least one year, and you must also have applied to renew your permit for at least another year. Long-term residents may apply earlier when reuniting parents.
Will my spouse be able to work on arrival?
Yes. The reunification permit of the spouse, partner or children allows employed or self-employed work with no further procedure, anywhere and in any sector, if they are above the minimum working age.
Can I reunite my parents?
Yes, first-degree ascendants of your own or of your spouse or partner, when they are dependent, over sixty-five and there are reasons justifying the need. Exceptionally those under that age are admitted on humanitarian grounds.
What if the person living in Spain has Spanish nationality?
The specific permit for family members of Spanish nationals applies, regulated in articles 93 to 98 of the Regulation. It is not general family reunification and its requirements must be reviewed separately.
Is an unregistered partnership valid?
Yes, if a stable cohabitation similar to marriage of at least twelve continuous months is proved by any means of evidence. With children in common that prior period is not required.
What happens if we do not use the visa in time?
The permit has no effect until the visa is obtained and entry into Spain takes place, which must happen within one month of it being granted. Letting that month pass means redoing the procedure.
