Arraigo socioformativo

Arraigo socioformativo swaps the contract for training: it is granted to someone enrolled or about to enrol in regulated training, or who commits to training promoted by the public employment services aimed at catalogue occupations. It allows up to thirty hours of work a week while studying, and its extension is decided in the classroom.

Which training counts

Article 127.d) refers to the training in articles 52.1.b) and 52.1.e).5 of the Regulation, in the latter case including level one, and adds in-person provision of compulsory education within adult education.

In practice this covers regulated vocational training and professional certificates, as well as in-person adult education. Before enrolling, confirm that the specific course fits those sections: it is where most files go wrong, because there is private provision advertised as valid that is not.

There is also a second door: committing to training promoted by the public employment services aimed at occupations in the catalogue of article 75.1. If completion of that training is not later proved, the permit ends.

Enrolment deadlines, the critical detail

The law sets the calendar precisely and does not forgive:

  • If enrolment has an official formalisation period, the arraigo socioformativo application must be filed in the two months before that period starts.
  • Proof of enrolment must be given to the immigration office within three months of notification of the grant.
  • Failing to prove enrolment in time is a ground for the permit to end.

In duly justified cases you may submit enrolment in a different course from the one originally planned, provided it meets the requirements above. It is a useful valve when the chosen course is cancelled or full.

Integration report: here it is mandatory

Unlike arraigo social, where a family tie can replace it, arraigo socioformativo always requires a social integration report on the same terms as section c). There is no alternative by family tie.

In the Valencian Community it is requested at the town hall where you are registered, on the Generalitat's form, and the competent body has one month to issue it and send it electronically to the immigration office. If it does not arrive in time and that is proved, the requirement may be shown by any means of evidence.

Working while studying: the thirty-hour limit

Article 131.b) sets the only work limitation among the five arraigo types: the arraigo socioformativo permit allows work as an employee for a maximum of thirty hours a week overall, paid at least the statutory minimum wage or the applicable agreement rate, in proportion to hours.

Thirty hours is almost a full working week, so the limit is less harsh than it sounds. What it does not allow is stacking jobs above that cap.

The extension is decided in the classroom

Article 132.2.b) makes extension conditional on the centre's report certifying promotion to the second year, for basic or intermediate vocational cycles. If the training ends before the year is out, extension is conditional on proof of the qualification or certificate obtained and on being in an active job search with registration at the public employment service.

Put another way: dropping the course midway through the year not only wastes the place, it closes the renewal.

General requirements, asked for in every type

Article 126 of the Regulation requires them to be met cumulatively, that is, all at once:

  • Being in Spain when the application is filed and not being an applicant for international protection with an open file.
  • Having stayed in Spain continuously for at least the two years before the application. Arraigo familiar is the only exception: it requires no minimum stay.
  • Not being a threat to public order, security or public health.
  • Having no criminal record in Spain or in the countries of residence during the five years before entering Spain, for offences provided for in Spanish law.
  • Not being listed as non-admissible in countries with which Spain has an agreement to that effect.
  • Not being within a period of commitment not to return to Spain.
  • Having paid the processing fee.
  • Not holding a stay or residence permit and not being a party to another procedure to grant, extend, renew or modify permits. This last requirement is new: it was added by Royal Decree 316/2026 and has been in force since 16 April 2026.

That last point deserves attention because it changes the strategy of many files: you can no longer have two procedures open at once. If an application is in progress, it must be decided or withdrawn before applying for arraigo.

How the procedure works

A permit for exceptional circumstances requires no visa and is applied for in person before the competent body, except for minors or people who need support to exercise their legal capacity, where their legal representative may file it.

With the application you provide a full copy of your valid passport, registration card or travel document valid in Spain; the signed employment contract where required; and the documents proving the specific situation claimed. For arraigo you also provide the criminal record certificate from the country or countries where you lived during the five years before entering Spain. The immigration office requests the Central Criminal Records report and the police report ex officio.

There are two cases where third-country records need not be proved: having stayed continuously in Spain for the five years immediately before the application, or having proved it in a previous application within those five years without having left since.

If the documents are incomplete, the administration requests correction with a deadline that cannot exceed fifteen days. If it is not corrected, the file is closed as withdrawn. That is by far the most frequent reason for the lost files that reach this gestoría.

Tracking the file needs no phone calls: see how to check the status of an immigration file. Once the permit is granted, there is one month from notification to apply in person for the foreigner identity card.

Frequently asked questions

Does any course count for arraigo socioformativo?

No. The training must fit articles 52.1.b) or 52.1.e).5 of the Regulation, including level one, or be in-person compulsory education within adult education. Committing to training promoted by the public employment services aimed at catalogue occupations also counts.

When must the application be filed?

If enrolment has an official formalisation period, in the two months before that period starts. After the grant there are three months to prove enrolment to the immigration office.

Can I work while studying?

Yes, as an employee up to a maximum of thirty hours a week overall, at minimum or agreement wage in proportion to hours.

Do I need the integration report?

Yes, always. In this type the report is required alongside the other requirements and cannot be replaced by proving family ties.

What if I drop the course?

Extension is conditional on the centre's report certifying promotion to the second year, or on the qualification obtained if you finished earlier. Dropping out blocks renewal, and failing to prove enrolment in time ends the permit.
