NIE, TIE and registration certificate: three different things
| What it is | Does it expire? | Does it give the right to reside? | |
|---|---|---|---|
| NIE | An identification number | No | Not on its own |
| TIE | The physical card documenting your permit | Yes | It documents the permit that does |
| EU registration certificate | The document for Union citizens | Not in the same sense | It proves registration as an EU citizen |
Confusing them is the number one cause of wasted appointments: someone books for «the NIE» when what they need is fingerprinting for their TIE, or the other way round. Before booking anything, find out where you stand by checking your file.
Who needs a NIE
Any foreign national who has to deal with the Spanish administration or carry out acts with economic significance. The typical cases: buying or inheriting a home, setting up a company, working, opening a bank account for certain purposes, signing before a notary, or processing any residence permit.
You do not need to live in Spain to have one. In fact, a large share of NIEs are assigned to people who do not live here and need it for a specific transaction. In those cases it can be handled through a representative with a notarial power of attorney, common in property purchases.
What it looks like
It is an identifier with an initial letter, a series of digits and a final check letter. For tax purposes, for foreign individuals the NIE works as the tax identification number, which is why the Tax Agency asks for it and why many people ask whether NIF and NIE are the same.
The legal framework
The rules on identifying foreign nationals are in Organic Law 4/2000 and its regulation, Royal Decree 1155/2024, which replaced the 2011 regulation and has been amended by Royal Decree 316/2026. Fee amounts are set by ministerial order: the current one is Order PJC/617/2025. Check the amount there before paying, because it changes.
If you have lost or forgotten it
The number is never lost: it is assigned to you permanently. What you may have lost is the document that shows it. It appears on your TIE, on the registration certificate, in immigration decisions and in tax documents. If you cannot find it on any of them, you can request a certificate confirming the assignment.
Ex officio or on request: two different paths
Article 205 of the Regulation distinguishes two situations that people constantly mix up.
Ex officio. The Directorate-General of the Police assigns the NIE on its own, without you asking, when a procedure is opened in your favour to obtain a document allowing you to stay in Spain, when an immigration administrative file is opened on you, and in visas that allow stays of more than ninety days in any one hundred and eighty without a separate permit.
At the request of the person concerned. If your link with Spain is through economic, professional or social interests and no file is open, then you do have to apply, with two requirements: not being in Spain in an irregular situation and stating the reasons for the request. It is the typical case of someone buying a home, inheriting, opening an account or setting up a company.
If you are outside Spain, the application goes to the General Commissariat for Immigration and Borders through the consular office. If you are here, it is filed with the Directorate-General of the Police, directly or through Immigration Offices and police stations.
Five days, and silence means refusal
The deadline is short and almost nobody mentions it: the procedure must be decided and notified within a maximum of five days from the application entering the registry of the competent body. If that period passes with no reply, the application is deemed refused.
In practice the bottleneck is not the decision, it is getting the appointment to file. That is why two routes avoid the wait: filing through a representative with a power of attorney, and requesting it at the consulate before travelling, which for a purchase is usually the quickest.
The number does not expire, the paper does
The NIE is personal, unique, exclusive and sequential, and stays with the person always: it must appear on every document issued or processed for them and on the stamps placed in the passport, except visas. It is not renewed because it does not expire.
What does expire is the paper certificate proving the assignment, which usually carries limited validity for proof purposes. And what people call «renewing the NIE» is really renewing the card: see TIE and renewing the NIE.
If what you need to know is whether NIE or NIF applies to you, it is settled separately: NIF or NIE.
Need the NIE and cannot come to Spain?
We handle it through representation with a notarial power of attorney, without you having to travel. It is the usual route in property purchases and inheritances.
Frequently asked questions
Does the NIE expire?
No. The number is permanent. What expires is the TIE card and the residence permit it documents.
Can I work with just the NIE?
No. The NIE identifies, it does not authorise. To work you need a permit that allows it.
Can I apply without coming to Spain?
Yes, at the relevant Spanish consulate or through a representative with a notarial power of attorney.
How much does it cost?
There is a fee whose amount is set by the current ministerial order, at present Order PJC/617/2025. Check the updated amount before paying.
Are NIE and NIF the same?
For foreign individuals the NIE serves as the tax identification number. We explain it in detail on its own page.
Is it the same as the green EU card?
No. The EU citizen registration certificate is a different document, although it also carries your NIE.
