Real Estate Transaction Registration in Spain
The final stage of the real estate purchasing process is signing the deed of sale (escritura) in the presence of a notary. Although this step is relatively straightforward, it can often present certain challenges. Ensuring that all transaction details are in order, funds are prepared and available, and all necessary documents are obtained are tasks best left to professionals.

Services for Registering a Purchase and Sale Transaction

All housing acquisition operations in Spain are conducted through a notary and must be registered in the Property Registry. The new owner needs to obtain a special extract called a "Nota Simple," which contains data about the property and its owner. This is a very important document that confirms your right to the property, allows you to conduct other operations with it, and serves as the basis for obtaining a long-term visa or residence permit for non-residents.

If you need to register a purchase quickly, contact us at YourGestor. Our gestor will make a request to the Property Registry, complete the registration in the shortest possible time, and provide you with a full set of necessary documents.

Real Estate Purchase Procedure

Selecting the Property and Collecting Documents
When the property is chosen, the next step is reserving it by signing a reservation agreement. The buyer pays a deposit to the seller to take the property off the market. After this, you can proceed to the next stages.
Opening an Account in a Spanish Bank
Having a local bank account is another requirement for registering a real estate transaction in Spain. The costs of opening an account are quite reasonable, and banks are generally accommodating to foreign clients. The procedure itself is straightforward. You will need to provide the following documents to the bank:
  • Passport
  • Proof of residence
  • Income statement and tax return
  • Proof of business ownership for sole proprietors
Additionally, be prepared to provide information about the origin of your funds.
NIE Registration
The next step is obtaining a Foreign Identity Number, or NIE, which is issued by the local police dealing with foreign affairs. To apply for an NIE, you will need the following documents:
  • Passport with a valid Schengen visa
  • Return flight tickets
  • Reservation agreement for the property
  • Receipt for the non-refundable deposit
  • Two copies of the NIE application form
All documents must be presented in both original and copy form.

  • Справку о доходах 2НДФЛ;
  • Справку места работы;
  • Выписку с банковского счёта;
  • Свидетельство о регистрации фирмы для владельцев бизнеса;
  • NIE и пр.
Каждый испанский банк вправе устанавливать собственные требования к пакету документов на рассмотрение ипотечного кредита. Если вы хотите получить выгодную ипотеку в Испании, мы готовы помочь вам в этом.

Obtaining a Mortgage

Purchasing property with a mortgage in Spain is quite common. Local banks are willing to offer loans to foreigners under favorable conditions. You can obtain financing for up to 50% of the purchase price at an interest rate of 2-3.5% per annum for up to 30 years.
To apply for a mortgage, the bank will require the following documents:
  • Income certificate (2-NDFL)
  • Employment certificate
  • Bank statement
  • Business registration certificate for business owners
  • NIE, etc.
  • Each Spanish bank may set its own requirements for the document package to consider a mortgage application. If you want to secure a favorable mortgage in Spain, we are ready to assist you with this process.

Property Ownership Registration

After signing the contract, the buyer receives a copy of the contract and the mortgage agreement if the purchase involves credit. The notary then sends the documentation to the state Property Registry. This body must register the transaction within three months. After this, the new owner receives the original deed and an extract from the Registry.
Subsequently, it is necessary to re-register contracts with utility providers and pay the applicable taxes.
